Terms of Service

These Terms govern your use of the pokechamp.gg website (the "Service"), operated by pokechamp.gg ("us", "we", or "our"). By using the Service you agree to them. If you do not agree, please do not use the Service.

Our Privacy Policy explains what data we collect and is part of these Terms by reference.

Who May Use the Service

You must be 13 years of age or older to use the Service. We do not ask for your age and we store no age data, so this is a condition you accept rather than something we verify. If you are under 13, do not use the Service or create an account; if we learn that an account belongs to someone under 13 we will close it and delete its data.

If you are between 13 and the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.

Accounts

Most of the Service works without an account. If you create one:

• Use an email address you control. Login is by Google or by a one-time code sent to that address, so whoever can read your email can login as you.
• The account is yours personally. Do not share it, sell it, or let anyone else use it.
• Keep it to one account per person. Creating accounts in bulk, or automating account creation, is not allowed.
• Tell us at hello@pokechamp.gg if you believe someone else has accessed your account.

You can delete your account at any time from your account page. Deletion is immediate and removes your content, votes and share links along with it; see the Privacy Policy for exactly what goes.

Display Names

Your display name is public. Choose one that is not offensive and does not pretend to be someone else.

Names are checked automatically. The Service enforces a length and character limit, keeps a list of reserved words (so nobody can pose as site staff or an official account), and screens names against a blocklist of slurs and profanity, including attempts to disguise them with lookalike characters. Names are also unique regardless of capitalization. If a name is refused you will be told, and you can pick another. We may also change or remove a name after the fact if it slips through, and repeat attempts are grounds for closing the account.

Because names are unique and public, changing yours has a cooldown: the first change is free, and after that you can change it once every 30 days.

Content You Create

Teams, tier lists, comp names and votes you create are "your content". You keep whatever rights you have in it. By making content public on the Service you give us a non-exclusive, worldwide, royalty-free licence to store, display, and distribute that content on and through the Service, including on pages that rank or feature it. This licence exists so we can show your public comp to other people; it ends for new displays when you make the content private or delete it.

Your content is private by default. It becomes visible to others only when you choose to make it public, and you can reverse that at any time. Note that a share link you have already handed out cannot be un-handed-out: while an item is public, anyone with its link can open it.

You are responsible for what you publish, and you confirm you have the right to publish it.

Acceptable Use

Do not use the Service to:

• Publish anything unlawful, hateful, harassing, threatening, sexually explicit, or that targets a person or group with abuse
• Impersonate anyone else, including site staff, other players, or official Pokemon accounts
• Publish advertising, spam, malware, or links intended to deceive
• Attempt to gain access to another user's account or content, or to any part of our systems you have not been given access to
• Probe, defeat, or work around the Service's security, login limits, bot protection, or rate limits, or automate login code requests
• Scrape or hammer the Service in a way that degrades it for other people, or use automated tools to place votes
• Vote in a coordinated way to promote or bury content, including by using more than one account
• Reproduce substantial parts of the Service's data as your own competing product

We welcome ordinary, considerate use of our public data by other fan projects; if you want to build something on it, email us.

Moderation, Suspension and Termination

We may remove or hide content, reset a display name, or suspend or close an account if we believe these Terms have been broken, if content is unlawful or abusive, or if an account is being used to attack the Service. Where it is reasonable to do so we will tell you why. We are not obliged to monitor content, and not acting in one case does not waive our right to act in another.

You can end this agreement at any time by deleting your account. We may stop offering the Service, or any part of it, at any time.

Pokemon and Third-Party Rights

pokechamp.gg is an unofficial fan site and is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokemon Company, Creatures Inc., or GAME FREAK. Pokemon and all related names, characters, images and other content are the property of their respective owners. Game data, names and images appear here for identification and commentary in a fan resource.

Everything else on the Service, including its design, code, and original text, belongs to us.

If you believe something on the Service infringes your rights, email hello@pokechamp.gg with enough detail to identify the material and we will look into it.

Accuracy of Our Data

The Service publishes game data, ladder statistics and calculated results derived from Pokemon Champions. Rankings and usage data refresh on a schedule and are a snapshot, not live. Damage figures, stat calculations and tier placements are our own interpretation of game mechanics and may be wrong or out of date, particularly after a game update. Use them as a guide, not as ground truth, and do not rely on them for anything that matters outside a game.

Disclaimer and Limitation of Liability

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any data on it is accurate.

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, content, or goodwill, arising out of your use of the Service. Nothing in these Terms excludes liability that cannot lawfully be excluded.

The Service is free of charge, which is a fact worth stating plainly next to the paragraph above: we have no financial relationship with you, and these limits reflect that.

Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and we will update the effective date at the top. If a change materially affects your rights or what you may publish, we will say so on the page. Continuing to use the Service after a change means you accept the updated Terms.

General

The Service is operated from the United States. If any provision of these Terms is found unenforceable, the rest continue to apply. These Terms, together with the Privacy Policy, are the whole agreement between you and us about the Service.
